I am writing to you to inquire as to your stance on the phenomenon of gambling systems being incorporated in video games. If you are not appraised of the issue, or do not yet have a stance, I would request that you investigate whether these systems do (or should) constitute gambling under [insert State/Country] law.
Essentially, certain video games today (e.g. Overwatch, Middle-Earth: Shadow of War, and Star Wars: Battlefront II, to name a few) are being marketed to the general public (which often includes minors) while including a system in their game which, if not actually gambling, is manifestly similar to gambling.
These games are often designed to have two in-game currencies that players may use. The first, the free currency, cannot be bought and is earned entirely through gameplay. The second, the premium currency, can only be bought by spending real money (and generally has more in-game purchasing power than the free currency, so as to incentivise such spending). Both the free and premium currency can then be used to purchase ‘lootboxes’ (at different prices depending on the currency used).
Lootboxes are digital items which contain randomised in-game rewards that are revealed, usually with a flourish of audio-visual stimuli, upon opening (see this example from the game Overwatch: https://www.youtube.com/watch?v=rG88hC0MrtU). In some games, the rewards are cosmetic only (meaning they do not offer any material in-game advantage to players or give them a competitive edge), whereas in other games they may also include rewards which give players a competitive advantage. Game developers often rationalise these systems by claiming that it enhances ‘player choice’, i.e. players can choose to spend the free currency which is earned through gameplay on lootboxes, or they may spend real money to skip ahead and purchase lootboxes at a faster rate with that currency.
In any event, the takeaway here is that players have the option to spend real money to purchase lootboxes. On a layman’s definition, this is gambling: players stake money on the chance of receiving a prize.
[THE FOLLOWING BIT IS ONLY RELEVANT IF YOU ARE AUSTRALIAN, EITHER REMOVE IT OR FIND YOUR NATIONS EQUIVALENT LAWS IF YOU ARE NOT AUSTRALIAN] Section 1.3AA of the Gambling Regulation Act 2003 (Cth) defines gambling as: (1) an activity in which— (a) a prize of money or something else of value is offered or can be won; and (b) a person pays or stakes money or some other valuable consideration to participate; and (c) the outcome involves, or is presented as involving, an element of chance. Lootboxes clearly meet (1)(c) as they involve an element of chance. They also meet (1)(b) as players must spend real money on the premium currency to participate. In fact, both Dutch (http://www.clockworkstorybook.net/games/dutch-authorities-investigating-...) and Belgian (https://www.pcgamesn.com/star-wars-battlefront-2/battlefront-2-loot-box-...) authorities have announced they are investigating whether these systems constitute gambling. A French Senator is also concerned over this issue (https://twitter.com/Jeromedurain/status/931184414909923329).
While some have argued that lootboxes cannot be gambling because players are always guaranteed to receive a prize of some description (even if the in-game reward they receive is not the one they wanted). This argument does not seem to hold up to scrutiny, as it has the logical implication that, for example, slot machines could avoid being considered gambling by always paying out a nominal prize at a value lower than the buy-in cost to play. Others have argued that lootboxes are not gambling because the in-game rewards cannot be converted back into real money (at least not directly through an official market), but again this argument seems flawed as it would enable casinos to avoid gambling regulations simply by requiring customers to purchase a non-exchangeable premium currency and then establishing internal economies which only traded in that currency.
Ultimately, I am of the opinion that these systems do constitute gambling. I would very much like to hear what your position on this matter is, and whether you will be investigating the issue further.

The company keeps getting pounded because GME is having a sell-off, which doesn't make any sense. But that's the market for you. It doesn't always make sense.
